Navigating the Institutional Vacuum of Personal Data Protection and Public Trust in Indonesia

Abstract
This study aims to examine the urgency and institutional prospects for establishing an independent personal data protection supervisory agency, based on the mandate of Article 58 of Law Number 27 of 2022 in Indonesia. The main problem in Indonesia today is driven by the rapid advancement of information systems, which increases the risk of data leaks. The method used in writing this article is normative legal research through legislative and conceptual approaches. Legal materials were obtained through literature studies and then discussed descriptively and qualitatively. The research results clearly demonstrate that the absence of a dedicated supervisory agency has created an institutional vacuum. As a result, legal quality is severely weakened, public accountability is low, and oversight patterns are partial, thus prone to conflicts of interest. However, various global comparisons demonstrate the role of independent institutions in safeguarding data sovereignty and enhancing public trust. In conclusion, the establishment of an independent personal data supervisory agency is an absolute constitutional guarantee to protect the privacy rights of every citizen, as guaranteed by Article 28G of the 1945 Constitution. Based on the results of an in-depth analysis, it is recommended that the president, as head of state, immediately ratify this independent supervisory agency to fill legal gaps, strengthen the enforcement of regulations, and provide fair, firm, transparent, and inclusive legal certainty for all personal data governance within the national digital ecosystem in a sustainable manner.
